Terms of Service

1. Acceptance and Scope
By visiting the website, requesting a trial, downloading a license file, or purchasing the Software, you agree to these Terms of Service. Installation and use of the Software are also governed by the End User License Agreement (EULA); personal-information processing is governed by the Privacy Policy; and refunds are governed by the Refund Policy and applicable law.
2. Consumer Service
Safrove provides Windows local-backup software and related licensing services to individual consumers. The Software may be used for lawful personal or commercial activities, but we do not warrant that it is suitable for any particular business purpose, regulatory requirement, continuity requirement, or mission-critical system.
3. Local Data and Offline Licensing
The Software runs on your local device and stores backup data at local paths you select. It validates authorization through an offline license.lic file. The licensing website still processes the licensing information described in the Privacy Policy when you visit it, request a trial, or purchase a license.
4. Your Responsibilities
You are responsible for safeguarding the repository password, maintaining independent copies of your data, reviewing source folders, permissions, capacity, repository status, and task logs, and regularly testing actual recovery. A lost password cannot be recovered or bypassed. You must comply with applicable law and must not resell, sublicense, crack, or circumvent licensing controls.
5. Backup Risk
Backup software cannot eliminate the risk of data loss. A successful backup, SUCCESS status, existing snapshot, or successful Quick check does not guarantee that every file was fully read, stored, or can be recovered. Storage media, permissions, locked files, malware, third-party components, configuration, and human action can affect results.
6. Intellectual Property and License
Rights in the Safrove Software, website, documentation, and trademarks belong to the author or applicable rightsholders. A license grants only a limited right to use the Software under the EULA; it does not transfer ownership or intellectual-property rights. Third-party open-source components remain subject to their own licenses.
7. Service Availability
The website, downloads, trial issuance, and support may be interrupted, delayed, or erroneous because of maintenance, network conditions, supplier failures, security incidents, or force majeure. Except where applicable law requires otherwise, we do not warrant uninterrupted or error-free availability.
8. Disclaimer
To the fullest extent permitted by applicable law, the Software and website are provided "AS IS" and "AS AVAILABLE", without express or implied warranties of merchantability, fitness for a particular purpose, non-infringement, or continuing compatibility. The complete Software disclaimer is set out in the EULA.
9. Limitation of Liability
To the fullest extent permitted by applicable law, the author is not liable for indirect, incidental, special, or consequential losses, including data loss or corruption, failed recovery, business interruption, lost profits or revenue, lost opportunity or goodwill, third-party claims, or substitute backup and data-recovery costs. Total cumulative liability is generally limited to the amount actually paid for the license directly giving rise to the claim.
10. Mandatory Consumer Rights
Nothing in these Terms excludes or limits consumer rights or liability that applicable law does not permit to be excluded or limited, including non-excludable liability for personal injury and liability arising from fraud, wilful misconduct, or gross negligence where applicable. If a limitation is unenforceable, it applies only to the maximum extent permitted, and the remaining Terms continue in effect.
11. Trials, Abuse Prevention, and Termination
We may use Machine ID, email, IP-frequency, and download limits to prevent trial or licensing abuse. We may refuse issuance, suspend service, or terminate an affected license for fraud, unlawful use, cracking, circumvention, or material breach, without limiting any non-waivable consumer right.
12. Changes
We may update these Terms and publish the updated date. Material changes generally apply to licenses obtained or renewed after the change unless immediate application is necessary for legal compliance, security, or abuse prevention. Changes do not retroactively reduce consumer rights that have already vested and cannot lawfully be waived.
13. Governing Law and Disputes
These Terms are generally governed by the laws of the People's Republic of China, but this choice does not deprive you of mandatory consumer protections under the law of your habitual residence. Disputes should first be addressed through written negotiation. Consumers may still bring claims before courts, regulators, or dispute-resolution bodies permitted by the mandatory law of their habitual residence.
